    Default Will I Be Able to Change My Sons Name in the Future if I Re-Marry

    My question involves name change laws in the State of: Massachusetts/Virginia


    Me and my son's father have never been married, never lived together, and live in seperate states, but were together for five years. I have full physical and legal custody of my son here in Mass. My son's father is the non custodial parent in VA and pays child support with no custody order. He has gone in and out of my son's life multiple times in his one year life, and now he's back. Things are going well now, and we agreed to add his last name to my surname for my son. I don't plan on marrying my son's father. If I re-marry, will my son be able to take the name of my future husband if I change his name now? Would it make it harder to change his name to my future husbands name if I hyphenate my son's name? Does it give him more power or more say?

    it won't make any difference. The father will be able to object to a name change in the future and is likely to win the argument. There is little reason for your child to take your new husbands name. Actually there aren't any I can think of.
