    Default Recovering Money From an Unauthorized Bank Transfer

    My question relates to legal practice in the state of: Florida
    I have a pretty complicated case in the court in Florida, which is on pending. Its about stolen money from my personal bank account (it was an unauthorized telephone transfer). The case was filed in 2009. The attorney I hired for this case didn’t do much. Even he did some mess in the case – he dismissed one of the defendants without telling me.
    Since I live in Europe now, makes the situation more difficult to deal with, because of the distance...but I really want to proceed the case with another attorney. I don’t want just to forget about this. I want my money back. More important they are for me since I have a student loan for Sallie Mae which I want to repay.
    So, two years now the case is still in the court on pending. I am so confused, afraid of mistakes and out of money to take actions. But I don't want just to forget about it. I want to get my rights to return my stolen money. I want some one to hear me. I want to believe in the US justice!
    I will appreciate any advice what I can do in this complicated situation. I belive there is an answer and there is some one to help me.

    Did you ever consider filing a complaint with the Florida Banking Commissioner http://www.flofr.com/banking/ AND with the FDIC? http://www.fdic.gov/about/contact/ask/

    Either has the authority to investigate and order the bank to refund your money.

    I'm often surprised that so many people think first of lawyers and courts when so many public institutions have regulatory authorities over them. That would include all utility companies, banks, insurance companies, title companies, and the list goes on. It's easy to find out from the web if they do and if not there is always a greater authority which would know. Here that's called the state Department of Commerce which has authority over all such lesser entities. For instance the Banking Commission is subject to the Department of Commerce, so just ask that greater department if an entity is regulated.

    A complaint to a regulatory agency is free, can be done without formal legal papers, and the odds are that if all you want is a change in behavior or a refund, you'll get it. Often the regulated entity will just give the refund as their answer to the regulators rather than go through a process first and then probably lose and perhaps also get fined. The regulated doesn't want to build a bad reputation with the regulator either.

    Consumer protection agencies, which are part of the regulatory agencies jobs, tend to side with the consumer. Not once have I ever failed to get satisfaction from such a complaint, but take note that I don't complain unless I have a good and solid complaint.
