    Default Alimony in Ohio

    I live in Ohio and I am currently going through a divorce with my wife who lives in Kentucky, the divorce was filed in Ohio by me. My job brought me here 5 years ago and my wife refused to move here with me. during the 5 years that I have lived here she has never ben up here once to see me, however I did regularly return to Kentucky to be with her. I have children but the are now adults. We have ben married 33 years but obviously separated for 5 of them. I have tried to work out a fair agreement on alimony with her for the last year. She has been getting $1200 a month for temporary spousal support since October of 2005. $1000 per month plus $200 for back support.
    She did try to get the support increased in April of this year and the Judge turned it down. She works and has worked for most of the marriage her income is about $28000 per year and I make $75000 per year plus I am drawing $12000 per year on a pension, I also receive a car allowance from my job of $11000 that is to take care of all of the expenses including gas and my car payment, I drive alot of miles on my Job. The Judge said that was not included in my income because I needed the car in order to do my Job.
    Her Lawyer Is trying to include this as income. However she is trying to get $2300 per month in spousal support for the next 10 years There is no marital property involved the house was sold 2 years ago, I let her have everything in the house. Being that she has a job that is self supporting is this amount of money that she is asking for realistic. I am also paying her credit card bills for her for the last 2 years totaling $500 per month. After taxes are taken out of my if she gets this kind of money that does'nt leave me much money to live on. Again, in the state of Ohio is it possible for her to receive this kind of money for just herself?

    The judge has already awarded $1,000 per month in temporary support, and has already denied an increase. It would suprise me if the judge were to suddenly decide that his prior assessments were wildly low, and that $2,300 should be awarded.

    Do you have a lawyer?

    yes, but I am very dissatisfied with his services. Probably will not have him at trial with me he took on the case as a friend thought it would be cut and dry turned out not to be and he has not put anything into it. This lawyer does not specialize in this field.

    Would I be better off going to trial with this lawyer anyway? Is a bad lawyer better than no lawyer at all? And after the divorce is final can I go back for a change in spousal support.

    Go to trial with a lawyer with whom you are comfortable.

    You should not count on the spousal support order to be modifiable, as sometimes an award or settlement is non-modifiable.
