    Default After Eviction of Adult Daughter, Can My Spouse Let Her Move Back In

    My question involves an eviction in the state of: fl

    What is the name of your state (only U.S. law)? Florida

    I've got the most pain in the butt daughter you could ever imagine.

    Back in January she was evicted from me and my wife's second home. I had to go through the eviction process for my own daughter. Luckily my wife was out of the country on the day of the hearing. If she wasn't our daughter would have still been held up in that home.

    Anyways to my question - from what I sense in a recent chit chat between my brother and my wife, it seems like my daughter is interested in going back to that home and guess what - mom - yes she supports her once again. My daughter was already ordered to leave that home before can she go back again?
    When that house was cleared I had a good friend change the locks and I made sure that I only had the only copy since I can't trust my wife these days when it comes to my daughter. She's got too much hear for her. But the bottom line is we need to cut her loose, she's 24 years old now.

    So basically two questions:

    1) Considering the past judgement back in January of this year (2012) that got her to leave the house, if my wife wants her back in there can our daughter still return and stay in that house?

    2) Although the locks of that home is now changed, can my wife get a locksmith to open the door forcibly?

    And yes the wife owns half of the home. 50/50.

    If I were to find her in the house one day and I decide to throw out all of her belongings out on the street what would happen? This of course assumes that mom let her in there.

    Please tell me I can throw out her belongings without getting trouble...

    No, you can't throw out her belongings without repercussions.

    Seriously, what's going to happen? Your wife could very well help her pick everything up, move it right back in and not only file for divorce but request exclusive use of the marital home - meaning YOU would have to move!

    You need to solve the wife problem before you worry about the daughter problem.

    Oh come on, my name is on that house what's going to happen if I throw out her belongings or forcibly touch her possessions what could she possibly do? Tell the police oh my dad threw my things out, they'd probably laugh at her. Give me a break...

    How in this day and age can you not throw someone's stuff out of the house when they don't even have their name on it???

    Because the other titled owner gave them permission to be there. I suggest you file a motion to partition against your wife and force sale of the property, to solve the issue.

    Sorry, but if the police would laugh at her, why would you have to use the formal eviction process the first time?

    So long as it's your wife's property too, she's free to invite whomever she likes to live there (and call a locksmith). You need to address this with wife; if need be, the only way you can resolve this is I imagine through a divorce.

    A motion to partition would not require divorce. On the other hand, she may declare a partition of the marital bed.
