    Default Fare Evasion Citation, PC 640(c)(2)

    My question involves criminal law for the state of: California

    I got a ticket (P.C.640 (c)(2) Misuse of Fare Media) from a VTA officer by misusing a vta pass.
    The officer told me that i could be in jail.. I tried to apologize my stupid behavior, and really regretted it.
    There were a couple of Sherifs around me, but they didn't give me any tickets, but just asking questions.
    This is the first time for me to violate the law, but i'm so scared of what'll happen.
    I just wonder what will happen later like fine, appearance in a court, or others?
    Is there any way to make up my mistake?

    Does your ticket how have a court date set? Usually you can either pay the fine or contest it by going to court. The latter is your best bet in trying to get it dismissed, otherwise, just pay the fine and put it behind you.

    Yes, it does have a court date set. I'm not going to contest it because I know that I made a mistake. Do you have any idea how much will the fine be at the worst case?
    I deserve getting punished by fine -- again I really regret & I won't do anything that might violate the law -- , but I'm not in a goog financial status now.
    Is there any other things possible? like jail or impact on car insurance, credit or record?... Any further comments or reply will be appreciated.

    The penalty for this violation includes a base fine of anywhere between $25 to $250 which after adding in all additional penalties and assessments will come out to -at minimum- $200 and up. In addition to the monetary fine, you will be required to complete a minimum of 48 hours of community service imposed by the court which must be completed within a 30 day period as required by law. If you are unable to pay the fine, you can inquire with the court clerk as to whether they have any sort of payment plan, whether you can request that the due date be extended to allow you more time to save up or in the alternative, they may offer the opportunity to do more community service in lieu of some of the fine amount.

    A first and second convictions of PC 640 are both considered infractions and are punishable by a monetary fine + community service but no jail time. It is filed as a misdemeanor if violated a third time and: (1) jail time can be considered for that type of charge and (2) that is a criminal charge which upon conviction will become part of your criminal record.
