My question involves a child custody case from the State of: Georgia
Not sure where my post should go but here's my story:
My ex-girlfriend and I got together before she was officially divorced. Yes, it was a bad mistake and I was oblivious to any laws or legal issues. I didn't find out she was married until a few months into our relationship. Things were going great so we decided to just continue in the path we're going while we wait for the divorce to be official. She then got pregnant with our son Logan. We decided to move in together to raise our kids (she has a 4 year old from her first marriage). The divorce was official February, 2012. My son was born May 17, 2012. At the hospital I filled out my part of the Acknowledgement of Paternity and she filled out hers. She lied on her divorce date stating February, 2011. After my son was born, she put him on Medicaid and received food stamps because she claimed to be a single mother with 2 kids, low income. Several months later, she decided things weren't working out between us and moved back in with her parents. I couldn't stand to be in the house anymore so I moved in with a friend. We have a verbal agreement on child support and visitation which I'm happy with but knowing what I know now, I have to legitimize my son and go through the courts to make everything official.
Being as she lied on the Acknowledgement of Paternity, who is held accountable and what are the consequences?
When I go through with legitimization and custody, will I be forced to pay the state back for her claim on Medicaid and food stamps?
I haven't seen or signed the birth certificate, does she have a right to put someone else as the father or giving someone else rights to my son without me knowing?
