    Exclamation Landlord Won't Refund Security Deposit Because of Early Move-Out

    My question involves landlord-tenant law in the State of: California

    I moved from Seattle, WA to Pasadena, CA for school. I talked to the owner, and secured my spot for the room by paying August rent ($500) + $300 security deposit. I arrived at the house on the 16th of August. The house is in terrible condition and I was plannig to move. No contract/lease or any kind of paperwork was signed.

    I found a new place to live, but gave the landlord a couple days notice (nothing was discussed beforehand about length of notice time). LL says he cannot refund the deposit because I am leaving a couple days before Sept. rent is due, and he "doesnt have the money to pay me back." I caused no damage to the property or room.

    If I move out on the 31st of August, technically I dont owe rent correct?

    Can I get the deposit refunded, or am I at fault?

    You won't owe for August since you already paid it but you will owe for September since you must give a 30 day notice. That would mean you cannot terminate your rental agreement until the end of Sept.

    well, you moved in without anything being signed, right? You paid money because you believed you owed it without anything being signed, right?

    A verbal contract is just as binding as a written contract as long as you can prove the details of the verbal contract.
