My question involves employment and labor law for the state of: MASSACHUSETTS
Hello all,
I am writing this because I want to know if I can sue said "employer" for amounts promised via verbal conversation and text message. Here is my story.
I went through some struggles in my life to where I lost my job and one of my wifes friends offered her and her husband's help with a job within her husbands construction company. Without drawing this out and making you guys read a whole lot... basically... It was said to me over the phone and in text that I had a guaranteed job waiting for me and I would be starting "soon"...
Upon getting this news of a job, I said to my wife's friend and her husband, that I didnt want to wait for a job, because bills were gathering and that I would need an exact starting time so that I can tell my landlord when to expect a rent check and so I can schedule all of my bills to be paid accordingly... and if I wasnt starting soon that I would need to decline her offer for a job.....
It was then ASKED of me in text... to "please wait" because her husband "needed" me due to an "injury" he had on the job that day... and that I would be paid for the time that I waited for my starting date in the amount of "$1000".
over the next two weeks I was getting the run-around from them stating that the company they work for pulled out of the contract and now there is no job for me at all.... but that they were still going to pay me for the time I waited in the amount of "$1000" they even offered me up to "$1500" but i said the original amount discussed was fine....
2 more weeks go by and all I have been hearing from them is "Our financial advisor..." this and "Paperwork..." that. They also took personal information of mine (Bank account numbers) so that they could wire me the money directly but there was always some "hang-up" delaying the transaction.
I told them that because of them ASKING me to wait.. that I couldve had a job by now and not had to worry about these bills and my landlord.. they even went as far as offering to pay my rent for me which i declined and just asked for the agreed amount for waiting.
Then they told me to tell my landlord that i would defidently have the money by "x" date and which i did....
Now today the news breaks that they've decided not to pay me at all because I am not a "Trusted employee" of their company and their mother doesnt see it necessary to pay me. I didnt even know anyones mother was involved!!!
Now My landlord has said that If i dont have money for him by the first then I am going to be evicted.. I have no money for my car insurance or ANYTHING. I have been living on basically $100 ever since I lost my job. And that is trying to support a wife and child as well!!!
I am very employable and have no problem finding work. In fact I got a job on the first day after hearing that I wasnt getting their job... but by the time I get my first check from my new job... It will be too late!
Can i sue them for breach of verbal contract? seeing as they ASKED me to wait because they needed me to work?
