My question involves landlord-tenant law in the State of: North Carolina
Greetings. My query is regarding a landlord who has not returned the security deposit after the end of the lease. The lease ended in July of this year, and I have as of yet to receive either an accounting or balance of the deposit. I sent the property agent the new address within a week of moving. I read the statute and sent a very nicely worded (more flies with honey, etc... ) letter after 40 days, inquiring as to when I could expect the accounting or balance. I received a reply the next week from an employee of the property agent, saying that "new laws" had been passed and they had 60 days to return the accounting and deposit to me. It's been about two weeks since that email, and while waiting for the 60 days to come around, the only thing my non-existent legal research skills has been able to find about 60 days is that the landlord can get an additional 30 days if they provide an interim accounting within the first 30, but that was not done and no one is saying it was. Have I been hoodwinked by the Agent misrepresenting the security deposit act? Can they do that? And if so, is there anything I can do legally now to get the return of the balance of the deposit?
