    Question Grandparent Adoption in Arkansas

    I have guardian ship of my grandson. He has lived withus since he was 5 weesk old. at 15 weeks I was given guardianship. My question is this..
    Do I need his mothers signature to adopt him?
    We have gone through one DNA to see if one man was the father. He was not. Now we are going through another man. I am doubtful he is the father as well. We just want to keep him stable and safe. He is a precious gift.

    It is a very difficult situation here.

    Is this legal guardianship through the courts? Has mom's parental right's been terminated? How old is the child now?

    Yes I have legal guardianship through the courts. He is now 15 months old. Her rights have not been terminated.

    Good that it is legal guardianship through the courts, to adopt her parental rights would have to be terminated or she would have to consent to the adoption as would the father if he is known.

    Well that is not what I wanted to hear but thank you.
    I wanted to adopt before the dna. The "fahter" is a convicted felon, just got out of the pen. He is married with 4 children by his wife and 2 outside of the marriage.
    She has made the statement she is going to petition the court to have the guardianship disolved. How difficult will this be for us to fend off?

    Also there is no father listed on the birth certificate right now if that makes a difference in all this.

    The father's status means nothing until he is proved to be the father, then it may be a factor in terminating his paternal rights in order to adopt. You cannot adopt without his consent. Once he is proved to be the father then he may own child support non payment of which could land him back in jail or give grounds to terminate parental rights. Mom has a right to file to regain custody of her child, whether or not the courts will agree is another thing. Was she ordered to pay child support along with the guardianship and is she current? If something were to happen to you, guess who is first in line to get the child back? Have you considered petitioning the court to appoint a Guardian as Litem to represent the child's best interest?

    She was not ordered to pay support. She did not have a job at that time. She has since had another child. We will prob have paternity done in November.
    I had not thought of a guardian ad. I will see about that.
