    Default Fired for Violating an Unwritten Policy

    My question involves labor and employment law for the state of: Missouri

    I would like to know if I have any grounds for suing my former company for firing me for a policy that didn’t exist. I was told that I was being fired for violating company policy and procedure. I was not aware there was any policy for what I was terminated for. I have been doing a lot of reading on the internet that employers should have written company policies that employees are aware of. An employee can be terminated for violating a company rule. The rule must be written, and the employer must be able to prove that the employee was aware of the rule.

    Another thing I would like to know if I can sue the company for slander? The general manager called me a “worm.” I will not say what exactly she said in case I find myself in a court of law later on. I agree not a nice thing to say and it might even sound a little like I am being petty about it. The thing of it is, is that I am not a “worm.” I work my butt off 10 hours a day doing heavy work. My body tires out and by the end of the day I’m worn the heck out. It’s pretty easy to sit behind a desk and make derogatory remarks about someone when they clearly haven’t walked a mile my shoes.

    Can someone shed some light for me?

    While it is a good thing for employers to have written policies and to make employees aware of them, it is not required by law. Missouri, along with every other state except Montana and even sometimes in Montana, is an at-will state meaning that you can quit at any time and for any reason, and the employer can fire you at any time and for any reason that does not violate the law. Firing you for a policy that you were not aware of does not violate any law.

    No, calling you a worm is not slander and does not give you grounds to sue.

    When she called you a worm, she may not have been referring to your work habits. Worms and hard workers are not necessarily mutually exclusive.
