    Default Can You Negotiate to Keep Real Estate, Post-Discharge

    My question involves bankruptcy in the state of: New York/New Jersey

    We filed for chapter 13 and had to give up our 2nd home in NJ. We are almost completed with our 5 year bankruptcy process and have been diligently paying our debt and living in our NY home. To date the bank has not foreclosed on our NJ home, could we go to the bank to request for negotiation to keep our 2nd home once our 5 year deadline is up? Or would they finally claim ownership of our second home as we complete our 5 year repayment plan?

    The only way to find out what they will do is to call them and ask.

    You've made no payments on the NJ home for five years? The bank has been paying the taxes? Has anybody been using the property? Maintaining it?
