    Default Will Speeding Ticket Points Follow My to My Home State

    My question involves a traffic ticket from the state of: NJ. I was pulled over yesterday by a local police officer on interstate 287 for a speeding ticket. I was told that I was going 85 in a 55 zone. My vehicle, drivers license are from the state of PA. My concerns on the alleged speeding violation is that the points would transfer from NJ to PA on my record. Also, from the situation, I saw the officer as I crested the hill where he was using LIDAR to target approaching vehicles. I was in the process of changing lanes from the "second" from the "right" lane, to the "second from the left" lane when my vehicle was targeted. There was a vehicle that was <500 ft. in front of mine, and I would like to argue that the officer did not have clear unobstructed view of my vehicle before he targeted. Is there anything I can do, or should I talk to the prosecutor in efforts to have the ticket amended to: 39:4-97.3 A.K.A "Unsafe Driving" which would carry a penalty of $150-200 and 0 points?

    I think you're way off on both ideas.

    1) Your claim that the officer did no9t have an unobstructed view of your vehicle isn't likely to fly. You don't know what he can or cannot see from his standpoint. He gets to decide if he had an unobstructed view and if not, it is not likely that he wold have tried to target your vehicle. So that's a no go...

    2) A plea bargain is an offer from the prosecutor to you in ana attempt to reduce his case load or quickly dispose of a case or whatever. So while you might want to make a suggestion as to which statute you would like the citation amended to, if he's pretty confident about his case (and with 85 in 55, your goose is pretty much cooked) he has the ball in his court and he gets to decide what to amend with if he chooses to amend at all!

    I still am not sure where the "while stupid" part comes in. Unless you mean the driving at 85mph, and if so I'd be inclined to agree!

    Oh, let me add this... You really could care less what how many points NJ will assign to a particular violation. Your main concern should be focused on when that violation is reported to PA, what will PA equate it to. You have to be careful, for example, you need to know what 39:4-97.3 A.K.A "Unsafe Driving" would equate to under PA's motor vehicle statute. If it is not a zero point violation there then that is not your best option. Ans soime times it is no so clear cut!

    LIDAR @ how far? Anything in NJ beyond 1,000ft requires expert testimony, and is not economically feasible for the state. They aren't going to spend thousands of dollars just to prosecute you over a speeding ticket.

    It's most likely under 1,000ft, but you should check.
