    Default Can You Get Emancipated if You Think You Can Support Yourself

    My question involves juvenile law in the State of: Illinois.

    Well, I don't currently live on my own but I have a job and I am fully capable of taking care of myself. I'm 17 years old and don't want to get emancipated right away. I graduate in May of 2013 and would like to be emancipated around or a little before that time so that I can move out right way. Does being a part of a low-income family help my case of being emancipated? My mom is on Social Security Disability and so is my uncle which whom lives here too. The annual income for this family is less than $10,000 a year, and I feel like such a bother and do not wish to live here any longer than I have to.

    (A) You likelydon't qualify - you have to be self-supporting to start with, financially.

    (B) Even if you did qualify, you would likely turn 18 before the case even made it through court. Even if you turned 17 yesterday....May is still 9 months away. You would only have another 3 months to tough it out.

    No, being part of a low income family doesn't mean anything at all regarding emancipation. The FIRST criteria is, are you, personally, without assistance of any kind, able to pay 100% of what it takes to support yourself and do you have a history of doing so? If the answer is no, then you will not be emancipated no matter what the circumstances. If the answer is yes, THEN the court will look at your circumstances and decide whether emancipation is in your best interest.

    Contrary to what far, far too many teens and even some adults believe, emancipation is not and never was intended to be a means for a minor to leave a bad situation. It was and is intended to be a means to provide legal protections to those teens who, for reasons outside their own control, found themselves living on their own.

    Thank you both, by the way I turned 17 in June and I will turn 18 after graduation. So I'll still have a month to tough it out. I guess I can deal with that.
