    Exclamation What Happens if I Fail to Pay a Civil Demand

    My question involves criminal law for the state of: Texas
    I shoplifted at a Texas Walmart in april. Was not arrested or given any kind of ticket or documents. The store took my photo said I could still shop there in the future. The officer taking the report did not arrest me because I was almost full term with my baby. I know it was wrong, against the law, stupid,careless and so on....but I did it and it's now August and since then I have moved (still VERY VERY close but in Arkansas not Texas. I thought about it and waited to see what happens. Now I have revived some forwarded mail and it says this is my third settlement offer to pay within 10 days! It was lost in the mail over a month and they want $550! I didnt even take $100 worth of stuff from the store. I plan on calling to see wth I can do. I can only afford $30 Max. Monthly payments. IF THAT! I just moved have 3 kids to take care of and my grandmothers care giver!

    My questions.......
    Will it go to court if I pay or not?
    I'm a breastfeeding mom and don't have that money or I wouldn't have shoplifted!
    What should I do?!

    If you ignore the civil demand they will track you down and the amount owed will be substantially more than what it is currently. I would say you need to make contact with them and set up some sorta payment agreement, then stick to the agreement.

    However, should you choose not to contact, they will get a judgement against you in a civil court and that judgement will be a bit more than it is currently and will be accompanied by whatever costs they've incurred in the process.

    If you show a good faith effort toward taking care of this obligation they may very well work out a payment plan that does not "hurt" you all that too much.

    Lastly, and you're catching me in a tender mood at the moment, never use some sort of lame justification to assuage a wrongdoing ever again! You're setting a rather poor example for your child!

    If you're not paying the high prices for formula, you should have more money and not less. Neither of those excuses justifies or excuses criminal behavior. As already mentioned, contact the folks handling the CD and they might work something out for you. Did the officer cut you loose completely, which I doubt, or just issue a ticket in lieu of taking you to jail? If you got a ticket, I wouldn't use those lame excuses in court.

    There are food pantries to turn to. Planned Parenthood helps with various baby needs. There's programs like WIC and Food Stamps. So shoplifting is no excuse when there is so much help out there to get food, etc.
