Default can this section help me

I hired a contactors to perform a job. He had done another job for me. On the first job, we had a contract and all, on in the body of this contract, he stated he was responisble for the material. On the second job, we did not have a contract. He has since billed me for the job and two items have happened.
    1. He billed me this time for the material, neither of us stated who would be responible for the material. However, I assumed that since it was included on the first, it would on the second. I am I right or is he.
    2. Secondly, he quoted me 1 price, then we he gave me the bill, it was not what he qouted me. He never told me or my spouse that he had incurred any problems that would increase the cost. I am I responsible for the additional cost even though I was notified about such increases

    Default Problem with Contractor

Without knowing a lot more about the situation, including the laws of the state at issue, the work performed and its reasonable value, it is impossible to give any meaningful answers to your questions.

Your first step is to try to negotiate a reasonable resolution to the dispute. If the contractor is willing, you may be able to work through a community dispute resolution center, or similar nonprofit organization which helps with resolving this type of dispute.
