My question involves child abuse or neglect in the State of: New York
Hi,
My step son's bilogical father disappered for over three years. He also hasn't paid any child support for 4+ years and was spotty 2 years prior. He sent a text to my wife today asking to talk. I have raised him since he was 2 and he is now 7. Per their intial divorce agreement he had rights to see him. I am meeting with our lawyer Monday to discuss everything. But in the interim, I am hoping someone can answer a few questions:
1) Being he disappeared for 3+ years(no contact at all nor any attempts) does he lose any rights per the original agreement
2) Can we stall any visitation whatsoever until he starts payments?
3) I know at this point I have no rights as his step dad, but we have a normal household. I am his father and he has a 8mnt old brother. He loves his life and this can disrupt a lot. Plus his birth dad has a long history of narcotic use(had to go through testing to get intial rights). Can we make his life miserable in terms of him retaining rights?
I am not in competition, if the guy was a good guy, I am all for him being a part of my boy's life. But he's not. My son does't even know him any more. He calls him his old dad and hasn't asked for him in over 2 years.
