    Default Dealing with Rental Company "Insurance"

    My question involves an injury that occurred in the state of: CA

    I was in an accident with another driver, I am not at fault 100% (I was rear ended, CHP showed up and took a report). Other driver is a foreigner and here on business and was driving a rental car.

    I have had the hardest time dealing with the rental company's "claims division." Because the rental company self-insures its vehicles, it does not have to follow CA law regarding fair settlement practices (i.e. accepting or denying a claim within 40 days). I get the feeling that the claims division of the rental company is not making efforts to resolve the situation and refuses to tell me what steps they have taken to contact the driver of the rental car.

    Anyone have any experience dealing with a situation like this. Just looking for some advice on how to deal with adjuster at the claims division.

    If you have collision coverage for your own vehicle, make a claim with your own insurance company.

    Has the rental company verified that the driver was an authorized driver and has collision coverage through the rental company? Do you know if the driver rented the car himself, or might it have been rented by his employer? Was he performing work duties at the time of the collision?
