    Default Interstate Child Suport Arrears Enforcement

    My question involves child support in the State of: The original case was in Va. but I now reside in NC. The case in matter is 30 years old but they have sent an order down to my current state. The paper is entitled "Arrears Only" and I am lost at what to do. They told me to file for a motion to get the amount or arrears modified and I did but I am not sure of what the outcome may be. Will they give me an opportunity to make payments at the hearing? or is the only option jail time. I thank you in advance for all they help you can give.

    Have you tried to arrange payments?

    Why haven't you been paying? (Yes, the answer might actually make a difference)

    Hello Sir,

    They were taking my taxes that I was filling for awhile and then I was injured at work and have not worked since. My wife is willing to pay monthly but is not able to pay the 350.00 they were asking for. I made the motion to reduce amount in hopes that they will work with what my wife is making. Would that be an option? You replied yes, was that towards being able to make arrangements at the time of hearing and will they expect payment that day? Thank you again for your help.

    No, I was saying that yes, the answer to "why haven't you been paying" might be important.

    Did you apply for disability? You haven't been paying this at all except for having your tax refund intercepted?

    I'm sorry, but the court is not going to be impressed with that. There is no basis for a reduction.

    This can't have been the first you've heard about this - so what have you been doing all this time? Did you file to modify when you were unable to work? Is there a timeline you can give us (when it was ordered, when you became unable to work, etc.,)

    Yes, I did file for disability but was turned down several times. I tried making arrangements with the other state but they were not willing to work with me. I filed for motion to reduce when the other state contacted this state right away. The court date is coming up and I am hoping that this state will be able to work with me. The papers that I received say "Arrears Only".
