    I am the parent recording phone calls between my child and myself, the child is being manipulated lied to and punished by the other parent for talking to me while my child and I are conversating.
    nope. that is exactly what I understood the situation to be. You are intending to record that conversation with the other parent in the background while they say whatever they say. Even if you could get away with recording your child, it is illegal to record the other parent without their permission. It appears recording without permission is a criminal offense and as such, you bringing the recordings forward simply proves your guilt. That is why you can't use them.



    FYI: And yes it has been ordered that the other parent not be there during the phone calls.
    the custodial parent of a FOUR YEAR OLD has been ordered to not be present while you speak to the child? So, is the other parent supposed to go for a Sunday drive while you have your conversation?

    I understand the legalites now and that is why I came here to ask.

    but no they are not the custodial parent, yes they are "supposed" to be anywhere but there especially when the child and I talk (thats ordered), the child should be under the grandparents supervision until he comes home to me

    and he was slapped in the face for spilling her beer today while they were driving....

    it really doesn't matter who the person is. Without their permission to record, it is illegal.

    as to whomever being there; rather than recording, keep a log of dates and times you became aware the other parent was there involving themselves in the conversation. While it is not proof, the judge could accept it as factual or at least believe it enough to address the situation.
