    Default Shoplifted in Texas, Now Live in Arkansas

    My question involves criminal law for the state of: Texas
    In April 2012 I shoplifted from Walmart in Texarkana, Texas. I wasn't arrested because I was due any time to have a baby. The officer said that an officer would serve me papers or I would receive something in the mail for court and to cooperate with what they ask for. I haven't recieved anything and I just moved and live in Arkansas. I can't stop thinking about it and am scared to death that they are gonna take me away from my kids and fiancé. I am a breastfeeding mother and am my grandmothers care provider. I KNOW what I did was wrong, stupid and careless but I know this needs to be taking care of. I'm scared please help me.

    Did you set up your mail to be forwarded from Texas to Arkansas? If you did, all you can do is wait for the civil demand to show up. They *may* have had a change of heart and trashed the paperwork but...who knows? As long as you set up your mail to be forwarded, all you can do is wait. As far as taking you away from your kids: I doubt that would happen, seriously. They have a hard time taking kids away from meth-head mothers so...for your situation, I don't see it. If you are that worried, you could call the Walmart and ask to speak to the Loss Prevention officer and ask what happened...I, myself, would not. Depends how bad you want to know...

    You can keep checking with the court to see if charges are filed under your name. Beyond that, it's a waiting game - we cannot tell you when, or even if, charges might be filed.

    The worst case scenario appears to be a warrant for your arrest. If it happens, they will get you sooner or later.

    I have changed my address but am still scared. Some things have taken over a month to get to my new address. Also twice someone has came looking for me at my old residence. One a cop and the other said he was there for a lost title which can't be right?! Do you think if they have tried to reach me and I have not responded I will go to jail when "found"??

    Perhaps, rather than chewing your nails and worrying yourself to death, you should contact the court or the Texarkana Police Department and inquire about the status of your case.

    What are my rights though? Can't they take me to Jail right then and there?? I have my 2 year old and 3 month old with me 24/7 they would have to go with me. That's why I have not went

    Pick up the phone.....call the Texarkana Police Department....

    If they say to turn yourself into the cops where you live now, tell them you will make arrangements through your lawyer.

    It should be possible to contact the court where the charge would have been filed to see if any files are pending under your name. The police may not even be aware of the status of any court proceedings, particularly if a bench warrant hasn't issued.

    If there is an open file under your name and old address, you can determine its status and make sure the court has your proper contact information. They may require you to update your address via a letter; that's going to be a matter of local procedure.
