    Default When to Seek a Continuance

    My question involves traffic court in the State of: New Hampshire

    I am a resident of Massachusetts. I got my first speeding ticket ever over Memorial Day Weekend in NH, and I believe I was not guilty so I asked for a hearing. I got my Notice of Hearing for a Pre-Trial Conference recently, however I cannot go to court on that date since I will be out of the country on vacation. Immediately after I return, I am relocating to Michigan to start my new job.

    The Notice of Hearing only gives me an option for filing a request for a continuance, however I do not believe a vacation will be a good reason for the Court. Even if granted a continuance, I still cannot come from Michigan for this speeding ticket hearing. So what would the best next step be? Ideally I would not like to change my plea, but somehow use the fact that this is my first ticket in 6 years since getting my license to get it dismissed or something along those lines.

    So you won't go to court now, obviously not during vacation and certainly not after vacation! Why would you submit a request for a continuance when you know you're not going to make it?

    If "ideals" were real, none of us would ever get any marks on our record simply because each and every time we got cited, we would only have to show our clean record to get a particular citation to get dismissed. So at this point in time, you need to get real before you lose the few options that you may still have... You can either make arrangements to appear in court, you can consult with attorneys near the court where you're scheduled to appear (and clearly the cost for this one may outweigh the benefit) or you can change your plea to guilty and accept and pay the penalty. There is a forth alternative but certainly not one you should consider. It starts with a failure to appear, it results in additional penalties and charges which may include additional monetary fines, a suspension of your driving privilege which can and likely will get abstracted to your home state resulting in a license suspension there as well, a warrant for your arrest (which may pop up upon your return from vacation if you don't act before you leave) and/or all 3... The fine, the suspension and the warrant.
