    Default "No Extradition" Warrant but Still Being Extradited

    My question involves criminal law for the state of: Florida

    My friend has had a no extradition warrant for a short while now and it was confirmed when he had his name and info ran by police a few times. They couldn't arrest him and so just let him go. The warrant is for child support in Missouri. Now that he's in jail at the moment in Florida, the online records show that he's being held for extradition. He just signed the waiver of extradition on the 7th. I don't get this. He's been let go other times because the warrant calls for no extradition. What could be going on with this? This is the third time he's been extradited to Missouri from Florida. I am aware of what a no "extradition" warrant is but how in the world can Florida hold him to be extradited on a no extradite warrant. He's supposed to get released.

    Anyone ever heard of this type of situation?

    Actually, it appears that you are not aware of what a "no extradition" warrant is...there really is no such thing. What I mean is, there is nothing that legally precludes a state from seeking extradition for ANY outstanding arrest warrant. States make decisions regarding whether or not to seek extradition for, primarily, financial considerations, not legal ones. When a warrant is put into the NCIC system with a notation of "no extradition," all that means is that the state has predetermined that the offense is not worth the cost of extradition. It does not mean that the state CAN'T extradite nor does it mean that the state cannot change it's mind. That notation is not immunity. Theoretically, a state could chose not to seek extradition for a mass murderer yet seek extradition for a failure to appear on a traffic infraction.

    Even if a warrant has a notation of "no extradition" does NOT mean that a cop in another state CAN'T arrest on that warrant. It would be rare for a cop to do so because it would likely be a waste of time...but, it is still a valid arrest warrant making the person subject to arrest. The person can still be arrested and held until the issuing state officially declines extradition...that "no extradition" notation on the NCIC record is not an official declination of extradition.

    Again, that notation on the NCIC record is just a courtesy to the other state, NOT a "get out of jail free" card. What appears to have happened in your friend's case is that he was contacted multiple times on the street by cops who saw the "no extradition" notation and decided not to waste their time. However, when he was arrested on FL charges and jailed, FL decided to contact Missouri and ask if they wanted him. Missouri decided to change their mind and filed for extradition. Hell, FL may have said, "This guy is being a pain in our butts, now. How about if WE pay to ship his butt back to you?" Nothing shady about it at all.

    gotta love it when a wanted person thinks they have beat the system only to discover they don't know the rules and the system kicks their ass.

    that is apparently friends first mistake. Yes, they could arrest him. As PTPD22 explained, they chose to not arrest as it was likely going to go nowhere.

    oh silly boy. A warrant does not "call" for no extradition. As PTPD22 stated, that is merely a notation placed by the issuing state expressing their intent. Apparently they changed their mind though and agreed to extradite. Isn't it a hoot how they surprised friend like that? He never saw it coming.

    This is the third time he's been extradited to Missouri from Florida.
    Maybe friend should stop doing whatever it is that is causing him to be extradited to Missouri, unless he likes visiting there as he has been.

    I am surprised the money is being spent on extradition to tell you the truth.

    Don't worry - the state will be "fining" him for all sorts of things to help make up the expense.

    It is nice to see state gov'ts proactively spending budget excess, in a productive manner, to enforce their mission.
