    Default Who Gets Custody of Baby when Unwed Parents Split Up

    My question involves a child custody case from the State of: TN
    My daughter is pregnant. She and the babies father are not dating but talking about how to raise the child together. (when they are fighting over custody and who's the better parent) If they lived together to try and make it work and it doesn't work, would my my daughter have a right to move out and take the baby? I have seen a case where teenage parents weren't married but living together and when the mom left she was told to return the child to it's home and file for custody. Is this now the common practice? Part two of my question is, does there now have to be papers saying who has custody? I always assumed custody automatically fell on the mother but again someone is telling me different. I don't know my daughters rights are, she doesn't either.

    Mom has absolute custody, unless and until Dad goes to court to file for visitation/custody.
