    Default Notice of or Application for Intervention

    Filed for Unemployment Compensation (UC) and was granted. Municipality (employer) appealed and won appeal though, due to no fault, nothing has to be paid back. I appealed to the UC Board of Review and was successful. Now the municipality has taken the next step (court filing) to reverse the order and decision. (they fear a precedent has been set)

    A copy of their appeal states if I intend to "participate" I must file a Notice of or Application for Intervention under Rule 1531 of the PA Rules of Appellate Procedure. What is that?

    Do I need to file this notice, for what reason, and where would I find an example of a filing?

    Will I be able to offer testimony or will the courts simply review the earlier submitted data and rule from that?

    P.S> This is in Pennsylvania

    You can find Rule 1531 here - and it includes a model notice. Appellate courts normally rely upon the evidence which is in the lower court record.

    Thanks for the link.

    A few facts in the case. The employers witnesses offered false testimony and I have proof. (this proof was not presented during the original hearing since there was no discovery and I did not realize they would lie)

    While the appeal I won clearly stated my testimony was more credible, their attorney is claiming that since my "proof" was testimony, the board erred in all of its reasoning and findings. (some of his "evidence" was documentary but not relevant to the case)

    It would be nice if I could present to the court the evidence I have, including how my employer instructed my office to operate in an illegal manner. I testified to that, the appeals board recognized it, and their attorney simply denies it in his court appeal.

    Would filing the Notice of Intervention allow me to support my testimony and/or are there any other reasons to file this notice?

    I can't advise you on a Pennsylvania legal matter, or the intricacies of Pennsylvania appellate practice. You should consider consulting a local lawyer.

    Been there, done that. Politics prevents some local lawyers from taking part, others I have consulted don't want to be bothered by this type of case.

    Let me simply ask this. In general what effect would a Notice of Intervention filing have on a court case?
