    Default Marriage to F1 Student - Visa Timelines

    Hello - I have been in a relationship with my gf for 1 year now. She finished her AA degree and is on her 8th month of OPT work experience program which goes for a year. After that is over she will need to apply for higher education at a cal state in order to maintain her ACTIVE F1 status. She attempted a fake marriage about 2 years ago that was audited and she quickly hired a lawyer and divorced. She has been stuck in the U.S. ... fearing that if she were to leave the country she would not get to come back because the Vietnamese government would see she attempted a marriage already. Of course she misses her family and talks to her mother every day on the phone. Anyways we have our up and down moments and she is cold hearted at times but I do see love in her and she is faithfull. The biggest hurdle we have had is our distance from each other. It been a long distance relationship.. I reside in california and she resides in texas. We have traveled back and forth numerous times and have 300+ photos together with friends and family. If I indeed marry (main reason to help) but because i love... but find out a few months down the road that she was potentially in it for just the green card what is my recourse to make sure she dosn't obtain the green card? How long until she recieves the temporary green card? When will the interview take place? I will definetly have her sign a prenuptual agreement to protect the assets I have before marriage. I'm concerned with the timelines of the whole ordeal.

    You have not shared any information about what this "audit" of her prior marriage was about. If you are stating that she attempted to adjust her status based upon a past, fraudulent marriage and that her petition was rejected, she's going to be subject to a great deal of scrutiny the second time around. And whatever your motives, the prior marriage and long-distance relationship you describe do suggest a high potential for a determination that her intentions are fraudulent. She should consult an immigration lawyer.

    IMO, You need to see legal and mental health professionals. You need to understand what you are getting yourself into; your posting indicates that you are setting yourself up for disaster. The fact that you are even involved with someone who has been so dishonest as to enter into a marriage simply for an immigration benefit leaves me very concerned about your future. You deserve better than someone who has you concerned about her honesty.
