    Default Florida Is chicken wire considered a fence

    Over 1 year ago I took chicken wire and some 1" x 4' sticks and made a big area for my dogs to run. I recently had a pool put in but have only move 1 side of erected chicken wire. I have received a letter in the mail today from my HOA stating that my pool was done and I needed to remove my safety fence immediatly. Well it was never a safetly fence. Since it has existed for over 1 year is there any grandfather law or am I able to leave it and call the area around the chicken wire a garden. My HOA is run by 2 freinds in the neighborhood and don't get along with either one. This is really a way for them to pretend that they run the community. I just want to know if there is anything I can do to keep it there legally. I do plan to put up a wood fence in the very near future, but now its a principle thing. In the letter there was no time frame to remove it just said immediately is that legal or do they need to give a time frame.

    I am a bit confused here - the HOA doesn't want a safety fence around your pool? More typically, safety fences are required around pools, and for that purpose the type of fence required is usually more substantial than posts and chicken wire.

    Grandfathering can apply when a new rule is passed after a condition comes into existence, so you may have a claim to having your fence grandfathered if the rule they are seeking to impose was passed after you built the fence.
