    Default F1 Visa Rejection Under Section 212(A)(3)(A)(I)

    Hi dear friends

    I am an Iranian citizen who had a F1 visa interview in US embassy in Tashkent/Uzbekistan. However, after several weeks, they informed me and 5 other visa applicants (they had interview on different) that our visas have been refused under Section 212(a)(3)(A)(i). It seems so strange that all of us have been refused in one single day and under the same Section! I read the mentioned Section and it is so unrelated to me (and other 5 applicants). We had NO RELATION to reasons mentioned in the section. I guess it happens since consulars of US embassy in Tashkent are not familiar with Iranian's case. Also, based on the information from friends who called Washington, it is noted that consulars in Tashkent do the administrative process by themselves, no action is done in Washington or other places.

    Now, I deferred my admission to Winter 2013, and the staff in University are providing a new I20 for me. I am going to apply for a US visa in your embassy. But, I have some questions:

    1) Can I apply again for a US visa? Or the rejection is permanent?
    2) Do I have any chances to be qualified to receive a F1 US visa?

    It sounds like you were rejected because your politics suck. As an Iranian, you likely have little chance to be approved in the current political climate.

    INA 212(a)(3)(A)(i) renders inadmissible any alien who the consular or immigration officer knows or has reason to believe seeks to enter the United States to engage solely, principally, or incidentally in any activity that violates any United States law relating to espionage or sabotage. If you and your friends were rejected on the same day, odds are it's because of the outcome of the same investigation.

    We don't know what inspired the finding. It would be sensible for you to consult an immigration lawyer.

    Thanks for your response.

    However, it cannot be outcome of the same investigation. We were not friend before, and there was not any relation between us before applying for a US visa. We had interview on the different days. The only common is that all of us studied (or applied) for Mechanical Engineering. How can Mechanical Engineering put us under 212(a)(3)(A)(i) ??!!!!

    Possibly you want to learn US engineering practice to enable the commission of future terrorist actions. I hear it is high on the list of occupations, near air line pilot.
