    Default Use of Blue and White Lights on a Vehicle

    My question involves criminal law for the state of: Indiana

    I am a complete and legally certified volunteer firefighter that was recently pulled over by police shortly after using the blue and white emergency lights on my car. He asked if I had any card or paperwork that gave me permission to have and use blue lights. I told him my fire department did issue us cards that gave us permission however it was expired and they had not given us updated cards yet. In my extreme nervousness of the moment I forgot about another card that I DID HAVE ON MY PERSON that gives me permission. Because I was unable to provide legal proof that I had permission to have and use blue lights, the officer gave me a class D felony for impersonating a public servant(firefighter not officer)and a class A misdemeanor for having blue lights in my vehicle. Later that day I realized the mistake I had made however by the time I was able to contact the officer it was too late because he had turned it over to the prosecutor. I am going to plead not guilty however I was wondering if anyone thinks I should get a lawyer or not. This is my first offence of such magnitude over a speeding ticket here or there. Any and all advice able to be given would be greatly appreciated.

    If it were me, I would start by contacting the prosecutor's office and offering to provide the documentation necessary to establish that you had the legal right to have the emergency lights on your vehicle.

    I agree. I don't see any reason why the prosecutor wouldn't drop the case once you've provided proof that you weren't impersonating. Please let us know how it turns out!

    my lawyer has tried for two days to get a hold of the prosecuter and its nothing but phone tag. he has copies of about 25 papers, cards, and certifications that say im a firefighter. all theyd have to do is run a search of my name on the state website and it would also show the proof. the prosecuter that i know of doesnt know so far about all my certifications but they did say they were setting up a warrant and charges but im still going to try to stay optimistic.

    Were you cited for HAVING the lights? Or, were you cited for USING the lights when you were not responding to a call?

    What code section(s) were you charged with violating?

    Were you in route to a call? Was there a legitimate emergency you were responding to? If so, do you have a copy of the dispatch record?
