    Default What Happens to a Subtenant After the Master Tenant Gives Notice to Her Landlord

    My question involves an eviction in the state of: California

    I moved into a 1-bedroom apartment 3 months ago. The agreement was essentially that I was renting the bedroom out but given unlimited access to the rest of the unit (kitchen, dining room and living room). The person I am renting from does not live in the same unit but does use the living room as office space and storage. He rents a separate unit in the same complex. I never signed a lease with tr management property or with my landlord. We had a verbal agreement.

    I just received a text message stating that he has given 30 days notice to the management to vacate the unit. However I haven't received anything in writing asking me to leave...

    My rent is due tomorrow and from what ive researched it sounds as though I should pay it as normal I avoid being given 3 days notice. I did pay a 1 month security deposit when I moved in as well. My name is on the utilities although my landlord pays them.

    At this point do I wait for a written notice, ask for a written notice? Does the management company have the right to evict me? I just for know what the rules are seeing as he is giving up his lease on the unit.

    You just told us that your landlord just gave you thirty days notice, and that you admit receiving that notice. You had best start making arrangements to move or to enter into a tenancy with the master landlord.

    You have not informed us whether yours is an authorized subtenancy. Fill us in.

    You owe rent through the end of your tenancy.

    I was never an official sublease. I don't know what his lease says... Management knew I was here and renting from him.

    I was wondering if a text message counted as official notice though. The exact words were 'so I talked to the manager and gave her 30 days notice that I will be vacating the unit and I was approved'

    It's not how I would recommend service, but as you admit that you were served with 30 days notice it would appear to have been successful.

    You do not appear to be even slightly confused about what your landlord was telling you.

    I guess I was more just hoping a text wouldn't count. I'm frustrated because he gave me the notice the day after I came out of the closet to him and told him I have a girlfriend. Kicking myself for not pushing harder to get that contract signed!

    A text message would be difficult to defend in court as proper notice if the tenant denied receipt or, even if receipt was acknowledged, if it was genuinely confusing with no follow-up; if it's acknowledged and understood, though, that's unlikely to be a viable issue.
