    Angry Returned Leased Car

    Hello

    Im in california and I recently returned a leased car to the original dealer after a brief 2 month extension. I returned the car on August 31, to avoid having to pay for September. When I called the car finance capital group to extend the original contract they said as long as I turn in the vehicle before the first of the month, I do not have to pay for any additional months. When I first extended my lease I had thought that maybe id extend it 4. They said that doesnt matter and I could have it for two, which is what I did, with no penalty.

    Here is my issue. When I returned the car on August 31st the guy who did lease returns wasnt there. They convinced me it wouldnt be a problem and I left. Well, little did I know that the next day on 9-1 some sales person would forge my signature with the odomoter reading stating I had returned the car on 9-1. There were two official documents with my forged siganture. Now, they want to charge me for September which is like $500.

    Whats my recourse? Forging someone's signature is obviously illegal.

    What are my rights? How should I proceed?

    Tell the lease person to talk with the person that told you it was fine to leave it there on 8-31.

    If they still insist that you owe for September, tell them to sue you in small claims court. They would have the burden of proving that you brought it in and signed the document on 9-01.

    If they end up suing you, you could subpoena the people that witnessed you returning it on 8-31.
