    Default Can You Get Emancipated if Your Parents are Helping to Support You

    My question involves juvenile law in the State of: California

    Hello, I'm 17 years old and my mom has agreed to sign my emancipation papers. I turn 18 in January, but for very personal reasons we feel that this is the best solution. I have a job, my own vehicle, and also I receive almost 1500 in survivors benefit every month. However, She will not let me move out without being emancipated because she does not want to be legally responsible for me if i am out on my own. She said she would help me still a little. So my question is if i am not living out on my own, but my mom states she is going to help me find an apartment will the judge still not grant it?

    1. Get married
      You will need permission from your parents and the court.
    2. Join the armed forces
      You need permission from your parents, and the armed forces must accept you.
    3. Get a declaration of emancipation from a judge
      To get a declaration of emancipation, you have to prove ALL of these things:
      • You are at least 14 years old.
      • You do not want to live with your parents. Your parents do not mind if you move out.
      • You can handle your own money.
      • You have a legal way to make money.
      • Emancipation would be good for you.p

    You have told us that you can satisfy #1 and #2. You have not given us any indication that you can satisfy #3. You say you can satisfy #4, but you cannot support yourself and will need money from mom - you can expect that to be a big concern for the court as it evidences both dependency (you're not in the same category as a self-supporting grown-up) and uncertainty (mom can get mad and stop giving you money). You have not given us any basis to assess #5, beyond suggesting that mom is so worried that you will get into trouble and get her sued that she wants no legal responsibility for you.
