    Default Bankrupcy Means Test

    My question involves bankruptcy in the state of: massachusetts

    after meeting with a attorney, he told us the means test for massachusetts was $82000 ( family of three)which you also add the year cost of the mortage,( 24000) plus the year payments on a auto loan...(5000)

    for a total of $111,0000 how true is this, i cant find anywhere where you add the mortage and auto loan to the income?

    You do not have an understanding of means testing:

    1. If you are below median income for a family of your size, you do not have to complete the full means test. For a family of 3 median is $82,873.00 in your jurisdiction. This means that if your gross earnings from all sources averaged over the 6 months prior to filing are no more than $6,906.08 per month you do not have to complete the balance of means testing.

    2. If your monthly average exceeds $6,908.08 you must complete means testing. The test allows you to deduct certain expenses which would include payment on secured debt (house and car). If, after you deduct the "allowed" expenses you have basically nothing left over you have "passed" the means test. The expenses are based upon local and national IRS standards.
