My question involves a child custody case from the State of: California.

My daughter, my ex husband and I are French citizen. My daughter and I are permanent resident in California since 2005 and my ex husband is living in France. The French Court gave jurisdiction to the American Court in 2007. In 2010, American Court gave me sole custody and legal share custody with my ex-husband.

While my daughter is in visitation in France with her dad, her dad (non-custodian parent) registered her in a French school without my knowledge or consent In June 19th 2012. He sent her to a psychologist July 9th 2012(without my knowledge or consent) to have a report made concerning allegation of abuse. The psychologist in this report states "The psychological interview with the child and her father does not allow to judge the truthfulness of the facts reported by the teenager or of the danger linked to it".

In the meantime, the father contacted the French Court (who doesn't have jurisdiction), July 12th 2012, to have the custody change and get the full custody. I never been served for this Court date in France which is going to be tomorrow.

As the date of Today, July 23rd 2012, another of the father's lawyer is requesting an ex-parte to have the US Court giving the French Court jurisdiction.

In her memorandum of point my ex-husband's American lawyer states that because the teenager asked to live with her dad and because of the allegation of abuses she is the victim at her mom's house because my ex-husband registered our daughter successfully in France in a French school, if the American Court refuses to give French Court jurisdiction, the American Court should allow full custody to Father. The lawyer wrote in her momorendum of point that there is a pending CPS investigation as related to the teenager report of abuses. I called CPS and talked to the person in charge of the report who told me that she had been contacted by my ex-husband's lawyer and that she told the lawyer that there was not pending investigation (CPS send me a letter and copy of all investigations that had been conducted and declared all allegations unfounded. In this letter CPS wrote also there was not pending investigation at that time).

I believe my ex-husband's American lawyer, is trying to cover an international child abduction in process and is clearly lying to the American Court. The lawyer asked for an ex-parte knowing that if i go in Court I will be able to show proof of the lies made by lawyer to mislead the Court.


Can my ex-husband, who is not the custodian parent, register our daughter in France without my knowledge or consent?
Can he asked the French Court, that has no jurisdiction to change the custody order made in 2010 by the American Court?
What action can be taken by the American Court against my husband and against the lawyer? (in the case where they have been acting illegally in this case).

I'm very scared, my daughter is supposed to comeback home on August 2nd but I doubt the father will return her. As a single mother, I don't have the money to take a lawyer so I do all the paper work on my own and until now I always won my case but this time I feel a little bit lost.
