    Default Limits of non-compete clauses

    I'm a physician in a critical care group that staffs various hospitals around the country. In September our group pulled out of a hospital in Charlotte NC secondary to personality issues, egos, compensation, etc. The medical director has called each of us personally and reminded us of the non-compete clause in our contract which precludes all of us from entering into a working relationship with this hospital. Is the non-compete clause enforcable in a hospital where our group left? most of the physicians in the group are independent contractors.

    If the group no longer offers services in the area, consider asking if they will release you from the noncompete clause. If they refuse, it may be that a court would deem that aspect of the clause to be unreasonable and unenforceable - but you may end up in court, so asking up front is cheaper and easier.
