    Angry Can You Make Your Landlord Extend a Lease on a Month-to-Month Basis

    My question involves landlord-tenant law in the State of: Minnesota
    We are currently in the process of purchasing a home that is a short sale. We would like to stay in our apartment until we move into our home. We are in the final steps of this short sale and our lease is up August 31st. Our landlord wants us to give him 30days notice by July 31st if we are moving or not. We do not want to sign another year lease. Can we legally just tell him another date like Sept 30th to move and not have our landlord agree to a month to month lease? Our one year lease renewal the first time was only confirmed in a email not ever signing anything. We have been living there for two years now. We were hoping out landlord would be understanding of our situation and let us just stay month to month. It does not seem to be the case since he had indicated that he has a friend who would like to move in if we do not renew for another year.

    Unless your landlord agrees, you either renew the one year lease or move when your lease is up.

    If you choose not to move out at the end of your tenancy, your landlord can commence eviction proceedings. If you cause him to lose the successor tenant by keeping him from providing the unit to that person, you could find yourself owing considerably more than an additional month's rent.
