My question involves a child custody case from the State of: MI. I'm am wondering if, now that my daughter's mom has been released from jail. This is day ten since our last hearing ending with me being awarded full custody. She just called and said she was in jail for 22 days. Said mother was released from jail on the work release program previously, and was fully aware of the proceedings. Basically, I would like to know if she can use the excuse "that she was incarcerated and was unable to attend". Even though my original motion and hearing was postponed due to her incarceration. She has had ample opportunity to come forth and protest before being re-incarcerated. please any one that can give me any intel on the matter at hand would be greatly appreciated.....
