    Default MIP Ticket for Alcohol in the Trunk

    My question involves criminal law for the state of: Michigan

    Can you get a MIP for alcohol in trunk of vehicle. I was not drinking nor was I aware there was any in trunk. There was nothing inside of car.

    Clearly the answer is "yes", as it's reasonable to infer that you're looking at a MIP citation for having alcohol in your trunk.

    Whose car was it? Whose alcohol was it? Who put the alcohol into the trunk? How did the officer come to be looking in your trunk?

    Its my car. The alcohol was my dads. He left it in trunk from using my car. He asked if he could look in trunk.

    Well, when dad talks to the prosecutor, provides proof that he purchased and paid for the alcohol, and explains that he put it in the trunk, forgot to get it out, and that you didn't know it was there, perhaps the prosecutor will believe him and agree to dismiss the charge. Better, of course, if you didn't have any of your own property in the trunk, or none that you would have recently needed or accessed (snow brush/scraper, jumper cables, spare tire, ice skates....).

    You have chosen not to give us the background to your consent to the search, but if you're not questioning the validity of the traffic stop or consent the officer didn't do anything wrong.

    No it was a normal traffic stop; tags expired first car in my name forgot dad put car in my name. I didn't think anything was wrong with given the officer ok to look in trunk. I am only 19 and this was first time pulled over.

    more than likely if you'd refused to allow a trunk search, the officer would've informed you that he's suspicious, called in a drug dog, of course the dog would "alert", giving him PC to search the trunk....
