    Default Grace period and J1 to F1

    Hi

    I came to alaska / Usa with j1 visa ( work and travel program ) . My visa expired at 15th of september. I have still 30 days ...and I want to know can I apply for the changing of visa status ( j1 to f1 ) in this period ? I read at I-539 form application must be before the visa expiration date but there is also saying
    "The delay was due to extraordinary circumstances beyondyour control;
    The length of the delay was reasonable;
    You have not otherwise violated your status;
    You are still a bona fide nonimmigrant; and
    You are not in removal proceedings.'
    "

    It seems unlikely that you could both apply and be accepted for an F1 visa within the timeframe you describe. The safest approach from an immigration standpoint would probably be to return to your nation of origin (before your stay exceeds your grace period) and apply from there. Consider consulting an immigration lawyer.
