    Default Ex-Girlfriend Wants Jointly Owned Property to Be Sold

    My question involves court procedures for the state of: Florida

    So I have a situation on my hands that I really need help with.

    I have an ex girlfriend of 5 years, whom we bought a home together, and owned jointly for about 1 ½ years, with my father as a co signer on the loan. We shared all cost of the home equally and I have proof. One day before our 5th year anniversary, she asks me profusely if we could get engaged on our 5th anniversary. I said i'm not ready for that yet. This created a huge problem. We broke up that night and she agreed to leave and go back to her parents since she didn't want the house.

    The next morning she started to pack and I left for most of the day. I came back home for 5 min to print off a coupon online and I hear her on the phone with someone stating she is in fear of her life and i've been making threats while she is in the kitchen putting dishes away, all on the 911 call that I have in my possession. Thinking this is going nowhere I continue to do what I am doing and then wait for the authorities to arrive and sort this out. Or not.... I was arrested immediately without a single word in. 2 hours after being arrested, my ex had my car towed from our garage and drained my battery. Of course I was released and everything was dismissed. But while this whole matter was going on, I couldn't go to our house to do anything, doing so would violate a no contact order, fine. Other than the fact that she was not maintaining the property in any way nor making any payments on said home either. So the bills were not getting paid while she had sole custody of the home.

    Next, I move back in the home, which had been damaged some, from her pets and movers. I bring the home up to speed and make all payments she didn't pay and have been continuing to make payments. We finally have a conversation about what's going to happen with the home. I tell her that I have no problem paying all the bills in full as long as she can agree to sign it over when I can refinance. I didn't have sufficient funds to refinance right away so I told her it would be a few years till I could. We both agreed.

    Eleven months pass and without any warning, I get a court summons, stating that she wants to property to be sold privately, and that I have never held up my agreement of paying for ½ of all related expenses which I have proof I did, and that I have someone living in the home and i'm collecting rent from them, which is untrue, and she wants that money as well. What? All the while she hasn't paid anything on the home in eleven months.

    Now they are sending me interrogatories asking for private information like bank account numbers and any evidence I have against them. I’ve objected to each interrogatory giving reasons why but still provided some answers to prove I am not hiding anything. This is the point to which it is now. How should I proceed? How far will this go? What can I do to contest this?

    So this whole thing is in the works and I know just how untrue and frivolously it is, what should I do in this situation? Any help would be greatly appreciated.

    You my friend, are not the brightest bulb in the box, eh? Sell the house, give her 1/2 the gain or loss .. and move on with your life. 1/2 the house IS hers .. does not matter who was making payments. You should have settled this when she was agreeable to handing over the house to you but no, you wanted to wait years (really, years?) and guess what? She changed her mind ... surprised? I'm not.

    Cut your losses.

    It will go on until it's finished, one way or the other. How long that will be, we won't know until the Magic 8-ball gets back from the repair shop, the crystal ball is recalibrated, or Madame Zuileka returns from her vacation, whichever comes first.

    If you want to keep the real estate, work out an arrangement with your ex- for an appraisal and then buy her share. Or cooperate with her in putting it up for sale, ideally with yourself listed as a potential buyer whose purchase will not trigger a commission for the real estate agent, and make the highest offer.
