    Default Punched By Ex-Wife During Visitation Exchange

    My question involves criminal law for the state of: Virginia

    Hello, I have a visitation schedule for my three year old daughter for every other weekend. My ex wife and her husband were suppose to arrive at 10AM SAT morning to drop off daughter. My daughter became hysterical saying that she didn't want to go with me. My ex wife making the situation worse by balling in front of the child (claiming she was upset her daughter was upset) and asked her questions like "Did you get hurt here??" "Did you see something scary here?" My daugher answered "Yes". My ex wife asked something about being hurt with a fork..and honestly I had to hold back from laughing. Where she got this, I have no idea.

    Mind you, my daughter has done this only during convienent situations for my ex wife in my opinion. This weekend being mother's day. I only put this in for you to understand what caused the alter-cation.

    I then said to her "You're not setting a good example. She's three and will say anything to get sympathy. She tells me al lthe time how you tell her that I'm not her father and that my sons aren't her brothers" She denied it, and I said I don't beleive you. She said don't call me a liar and as she got closer and then she punched my face in front of our daughter and her husband. My wife was sleeping with our children in the house.

    She kept touching me forcefully, and I told her "Stop touching me. Put Lizbet in the house and leave" She said she wouldn't leave her. (Also breaking our visitation which I've handled)

    Hopefully that's a clear description, I called the cops who informed me that because I had no personal witnesses and no marks on me nothing probably would be done. I explained that I wanted to make sure it was documented so she understood that she cannot do stuff like this. She tends to think the law works around her. So they told me how to press charges etc. Anyways I have court tmo, and was curious about what kind of case I had? Will they just dismiss because I had no witness? I've never been any kind of court or situation like this so was just wondering what to expect. Thanks!

    We're talking about a criminal prosecution of your ex? What type of court hearing is scheduled?
