    Default Getting a Custody Order and Permission to Move

    My question involves a child custody case from the State of: Florida
    Here is my issue. I have a son with someone I was never married to. I never took him to court for child support as we had a mutual agreement as to what was "fair." I never saw it as fair but if I hadn't agreed, he would've given me nothing. He also paid for aftercare. He lived within 15 minutes of my home and only saw him once every two weeks. His contract ended and now he has a new contract with a new company in another state. I had strict rules for my son and when he had him those rules went out the window, despite the fact he (father) would agree to the rules. It was a whole other ballgame when my son visited. I want to file for full custody of my son for two reasons 1) I have a job opportunity that will provide me a better of quality of life elsewhere and now that his father is no longer in the state, I want the freedom to take on the opportunity and 2) I want control of my son's education, his upbringing, his health and without having to seek permission from his father. Now that he is out of the state, I feel I can move on with my life and take my child with me without requiring his father's permission. His father will still be able to know where we live, etc and I am also seeking court ordered child support. Can anyone tell me what are my chances for success?

    It's difficult to say whether you'll win, but typically the primary caregiver is generally given more favorable terms by the family court. Courts arrange custody and support payment schedules in ways that are best for the child himself. So when it comes to uprooting a child and moving to another state/place where access to the child by the co-parent is limited, courts are hesitant to grant such request. Usually the first step to getting this is attempting to get sole custody of the child or to get your ex to agree to the schedule. Either option will help immensely in allowing you to get what you want.

    But remember, it's hard to predict what a judge will do as family dispute outcomes are generally quite case-specific. If you can swing it, the best option would be to try and get your ex to agree to your terms and then present and formalize your agreement with the family court.

    Without any court orders for custody, you already have sole custody.
