    Yes, they can violate him for that. He could also be violated for the disorderly conduct. No, he can't appeal it until he is convicted and I'm not sure what the appeals process is, if there is one, for appealing a violation of probation. He is free to fight the violation but it will be an uphill battle. It's way too late to appeal a 10 year old conviction as far as I know. Did he not have legal counsel? His parents should have been involved even if he was removed from the home.

    Thank you. His parents divorced when he was 7, his dad worked out of state. His mom is an alcoholic who shortly after hus conviction lost her home and went to rehabilitation out of state. She was uninvolved in his defense, partially due to her own history as a victim of sexual abuse at the hands of her mentally challenged brother, and partially due to her alcoholism and inability to cope. His mom basically left him to rot, with no regard as to what would happen to him. His fatger tried to intervene and the state of MN imposed a restraining order against him due to abuse that his children suffered at his hand. He was not allowed to contact his son in any way until he was 18 and released from foster care. His grandparents also tried to intervene. They requested visitaion rights while he was in foster care, they attempted to gain custody, and were denied. They also were not allowed to contact him in any way. He remembers them coming to his foster home once, and seeing them out the window when his foster parents refused to allow them to see him. It is all a huge mess. I am curious to know if he can't take this back to the beginning and be exonerated of his status as a sex offender. What boggles my mind is that he took and passed a lie detector test, and his sister recanted her accusations and yet he was still convicted. His chikdhood was taken from him, and he is forced to identify himself to the world as someone who he is not. Now he is facing the possibility of losing more of his life to prison, over something from his chikdhood that he never even did. Also, I am eight months pregnant. If he goes to prison for this, he will miss the beginning of his own chikrds life and that is something that I refuse to allow to be taken from him over this.
