    Default Shoplifting questions

    Just two random questions:
    1) what does the store do with the photos they take of shoplifters? i was photographed with the items I stole, and wondering if they post it in the back office or keep it on file as evidence? I ask because I know people that work in the store, and wonder if my guilty portrait is on the wall for all to see. i realize this probably varies, i just welcome some insight.
    2) when i paid my civil restitution, i paid the maximum amount allowed in my state, Idaho, plus the value of the merchandise I stole--but I returned all the merchandise. in the statutes i have seen copied here, the defendant appears to be responsible for the maximum amount always, but only must pay for the items if they are not returned in sellable condition. is this different in my state or was the lpo wrong? it is only $8, but i ask out of curiousity.

    Your picture is part of the case file and confidential, it won't be posted. I can't say what the deal is on the civil demand, I don't get involved with them.

    As a cashier as a rather large 'Mom and Pop' store in Ohio. LPs don't post photos of shoplifters for us to look at or identify but we do have a bad checking account list that we use.

    The attorney I asked said that he usually advises his clients to not bother paying the civil demand amount, as I've seen other people reporting about their attorney's advice as well.

    But then this opens you up to being sued in civil (as opposed to criminal) court for the amount if the merchant decides to do so.

    But then, according to the attorney, this is rarely pursued.

    I don't know if he was just telling me that so that should this happen, as others have conjectured, he would also have another opportunity to bleed me in order to represent me in civil court too even.

    hmm Nariya, that is interesting. I was under the impression that if I did not pay the civil restitution I would be contacted by a collection agency, who would, I assume, take me to small claims court for the amount, plus probably the court costs. I already paid, which while frustrating, is at least over with. After all, I am guilty...I think you're smart to have contacted an attorney.
