My question involves landlord-tenant law in the State of: NY

recently my landlord hired a contractor who started redoing the facade of the building (6-8 appartments in building). work started somewhere in the middle of the week. not sure what exactly they were doing, but there was no noice or dust and i had couple of my windows open which are facing the work area. on saturday morning, they we doing dry sanding and my whole apartment became covered in dust from sanding. all floors, all furniture, everything. I complained to contractor that they should have at least covered the windows from outside during the work. they said ok , but didnt do anything and continued to work. next day (sunday) they were continuing to work and the dust was coming thru even closed windows which were still uncovered by contractor. i also called landlord to complain, and his only answer was that he is sorry and he is not responsible for anything, nor does the contractor and its my fault for not closing the windows. my answer was that first of all they should have at least let tenants know that they were going to perform dry sanding. second, they could have covered the windows from outside. and third, the work was done on saturday and sunday, which i believe is illegal.
i also stated that I will need to hire cleaning company and will deduct that sum from his rent and send him the bill along with my rent.
his answer was that i cannot do it and must pay in full and the rest is my own problem.

what are my opttions and who is right here? what can i do?. btw, i no longer have a lease, since it expired and I never signed a new one.
