My question involves criminal law for the state of: Iowa
I was arrested in Iowa for possession of 2 oz of marijuana (and intent to deliver, though I'm pleading not guilty of that) and failure to affix a drug tax stamp. I was just driving through and am originally from New Jersey, where I'm living now. Its my first offense, and I didn't even buy it (it was a gift), but I know this doesn't matter. I do have a good lawyer, and he told me I would not go back to jail, but Im not sure if thats just something they all say. I figured I may get anywhere from 2-3 years probation if Im lucky? I've been researching other similar cases, but still have NO clue what to expect.
If I do get probation, how long or will it take (or usually takes) for me to get a probation officer if its being transferred to NJ? Or will I have to report to a PO in Iowa before it gets transferred? Also, is out of state travel always restricted on probation, or only some?
