    Default Held for Contempt of Court Over Fines That Have Been Paid

    My question involves criminal law for the state of: LOUISIANA

    My boyfriend got arrested about a week ago because there was a warrant out for his arrest which we thought was for a court date he walked on during probation but after speaking to his PO she it was not that she had gotten that warrant removed. She looked it up and it was for contempt of court (pass due fine of $700) but the thing is it wasn't pass due (PO verified she said he is doing great and that he should not even be in there he was up to date on all payments passing all drug test only one month of probation left.) Somehow it didn't show up as being paid in the collection system. Next payment isn't do til the 13th this month but the PO said that if we go ahead and pay the remaining balance ($207)(we paid) he could be released without seeing a judge because the matter had been resolved. He is still in jail missing work for nothing the judge has been out all week. The whole thing is quite a mess but his PO is doing all she can to get him out so he won't lose his job.


    My question is, IS this true even though the judge has a hold on him (can't be released til seen), he can still be let go?? Since there is no longer a case to review its been resolved because no more money is owed.

    He'll probably still need to see the judge. It should be a simple in-and-out thing though - if he's all up to date and it was an administrative error, it should be painfully simple to put it all to rest.

    Darn that's probably another couple days the judge won't be back in til Monday... is there no one under him (the judge) that can clear him possibly??

    If a judge enters a contempt charge, the judge has to be the one who addresses it.

    From what you told us, he can pay $207, presumably as a bond to cover the allegedly unpaid fine, to get out of jail. Once he's out of jail he can address how to get that money reimbursed or applied to his future obligations.
