My question involves criminal law for the state of: Washington DC
I need some advice about my citation under DC code D.C. ST § 25-1001.
First, I am wondering about this being a misdemeanor. Under the code it is listed as a misdemeanor, and I am worried about this being on my record. I am actually not guilty of the offense, but I don't want to have to come all the way back to DC to contest the violation. Is there anyway to have this reduced to less than a misdemeanor, without full dismissal?
Here are the facts:
Several Metro Transit Police approached my friends and I as we exited a Metro Subway. One of the individuals in my party did have an open container or beer, I did not. I did not speak to the officers except to give them my identification, and to comply with their requests. Obviously, I did not admit guilt as I wasn't guilty. There is no evidence to suggest I had an open container, however, there are no cameras on the subway to prove my innocence. I was issued a violation citation for possession of an open container. I politely asked the officer about the fine and what I should do. He told me that I was being cooperative, and when these get contested he never shows up in court, therefore they are usually dismissed.
What are my best options? Like I said I don't want to have to fly all the way back to DC to contest it if I don't have to, but I will if that is my only option.
