    Question Accused of sexual harassment in Tennessee

    I work at a convenient store, and i recently got accused of sexual harassment. I was accused of rubbing men on the arms, making passes, and scratching the plam of their hands. I run the register and when i give money back to people i put my hand under theres to prevent lose change from falling into the floor. I never have made a pass at any of my customers.. and then i also got accused of making passes at co-workers, there are four girls( including myself) and one guy.. i'm not gay so i have no reason to make passes at girls( to me that's just wrong).. and i don't make passes at the new guy either..She(my manager) is also saying that another customer told her that i let them take cigerettes with out paying for them, because they had change. She is also telling me that i can't eat at a curtain place. and if i work i have to eat before i come into work.. all the accusations are false.. The other (female) employees talk and say profane things to guy customers then i have ever hurt of and they don't get blamed for it.. but i have been fasely accused of sexual harassment. when the manager was talking to me she told me she had no proof or evidence.. what should i do?[/SIZE][/FONT]

    Harassing who? An employee or a customer?

    Is this a franchise store (7/11, AM-PM, etc.) or an independent store?

    for harassing a customer... it's open from 5am-12:30P.m. monday- saturday and sunday 7am-11:30 p.m.
    and the store that i work at is chained-linked..

    I would suggest, if you do not get fired over this, to not continue doing what makes the customer feel uncomfortable. You can legally be let go just by the implications from a customer, that they felt they were sexually harrased, even with no proof, sorry!

    I don't even know who the customer is.. and by law i'm required to know, so i can confront them.. does a formal complaint need to be filled out by the customer? If so, then there wasn't a formal complaint filled out.

    No, actually you don't ever know who the accuser is, because you are not being legally charged, you are just in trouble. There are laws that protect the accuser, so your job actually can't tell you who made the accusation. I know this sucks, but if they did, and you harrassed this person, your boss could get in trouble. Someone will correct me if I am wrong, but I have heard it enough to feel confident in this. I really am sorry this is happening, and I do not agree with thier reasoning, but I am only here to state what I know legally. I don't know if they have to fill out a complaint, but once again, the boss is not obligated to tell you who said it, just that it was reported. Did you get fired over it?

    No i still have my job.. thank God!.. but there is that what if in the back of my head.. if they do fire me (hoping they don't) can't i sue them for that, since they didn't have proof, and since it's my word against theirs? i just don't like being accused of something that i know i haven't done..and I've even told my manager that I'd be willing to take a lie detector test, just to prove i didn't do it. while my manager was talking to me about the complaint she had the office door open to where the other co-workers could hear what was said. is there anyway i can sue for false accusation? what do i do? do i change jobs? i'm so confused.. it feels like my head is going in circles..

    No, once again just an accusation is enough to fire you. They are doing nothing wrong, at least legally. It was tacky to keep the door open, but not illegal. Once again, the burden of proof only applies in court cases, if the person was trying to sue you for monetary gain. Sorry again!
