    Default Bankrupcy and Divorce

    I was just wondering how does it work when you get a divorce in the process of paying out a Chapter 13 Bankrupcy? They just revised the bankrupcy due to the housepayment doubling and have not even made a payment on the updated plan...

    It can be complicated, as the assets of the marital estate are typically subject to the jurisdiction of the bankruptcy court. It may be appropriate for a divorcing couple to seek leave from the bankruptcy court to permit the divorce court to divide their assets and obligations in relation to their debts, subject to approval of the divorce court's order by the bankruptcy court. It would likely be helpful for at least one spouse in the divorcing couple to use a divorce lawyer who is familiar with bankruptcy issues.
